Steven Avery's ex-Fiancee Says 'He's Not Innocent'

Steven Avery, the subject of the Netflix series "Making A Murderer", has submitted a fresh appeal against his murder conviction claiming that one juror tainted the proceedings. DNA evidence later proved he did not commit the crime.

He also claims juror intimidation led to the guilty verdict.

Making a Murderer is a 10-part documentary series that follows the case of 53-year-old Wisconsin native Avery.

Dassey, who was 16 at the time of the murder and enrolled in special education classes, confessed to the gruesome killing of Halbach, but later told a jury he made it up.

The documentary series has captured national attention for casting doubt on the 2007 murder case against Avery, but has been met with some resistance. The report comes just two days after lawyers Kathleen Zellner and Tricia Bushnell announced their intention to represent Avery, who is now serving life in prison for the murder of young photographer Teresa Halbach in 2005. The error-laden appeal, which was filed on Monday and can be read in full on Scribd, argues that the state's evidence against Avery had been obtained wrongly and therefore was "FRUIT OF THE POISONOUS TREE". The first warrant to search the Avery property had multiple properties - and he claims that makes it a warrantless search with any evidence seized being determined illegal. "Making a Murderer" has inspired petitions to President Barack Obama and Wisconsin Gov. Scott Walker, as well as a critical probe of the country's criminal justice system. "I ate two boxes of rat poison just so I could go the hospital", she said.

The songs could have some influence on the next step for Steven Avery's case. Sellen said that pursuant to Wis. Supreme Court Rule 22.40, he could not confirm, nor deny whether or not Aquino was under investigation. She said in a statement that the defense has uncovered new evidence that will exonerate Avery - but she didn't say what it was.
